Coaching Agreement & Service Terms

1. Relationship

I understand that coaching is a Professional-Client relationship that is designed to facilitate the creation/development of personal, professional, health, financial, business and spiritual goals and to develop and carry out a strategy/plan for achieving those goals. Coaching is a partnership focused on developing the client’s awareness, beliefs, and lifestyle in order to help the client identify and achieve their life related goals. In coaching conversations, I will be direct and honest and encourage the Client to do the same. The success of the coaching engagement depends upon the Client’s commitment and openness to the process. If the Client believes that coaching is not working as desired, the Client agrees to communicate this to the Coach. 

 

2. Confidentiality 

Kyle Jason Leitzke fully protects the privacy and confidentiality of the communications with its Clients. I understand that information shared will be held confidential unless I state otherwise, except as required by law. I understand certain topics may be anonymously shared for teaching or consultation purposes.

 

3. Trust

The goal is to have a coaching relationship that is open, honest and trusting. If the coach ever says or does anything that upsets me, I will bring it to the attention of the coach so that it can be resolved as soon as possible.

 

4. Approach / Method

Coaching is generally conducted via Zoom/video conferencing, telephone, or in-person. I understand that coaching is a comprehensive process that may involve all areas of my life, including work, finances, health, relationships, education, recreation and spirituality. The coach is trained to utilize heightened communication, intuition, assessments and support skills in coaching me through multiple areas of life.

 

5. Not Counseling

I understand that coaching does not involve the diagnosis or treatment of mental disorders. I agree that it is not a substitute for counseling, psychotherapy, psychoanalysis, mental health care or substance abuse treatment and I will not use it in place of any form of diagnosis, treatment or therapy.

 

6. Not Professional Advice

I understand that coaching is not to be used as a substitute for professional advice by legal, medical, financial, business, or other qualified professionals. I understand that my decisions and actions in these areas are my sole responsibility and that I will seek independent professional guidance where needed.

 

7. Not a Licensed Physician

In the course of coaching, I may be recommended lifestyle, exercise, dietary or herbal remedies drawing from the complementary health systems of Ayurveda, Yoga or Vedic Philosophy. I understand these services are provided for informational purposes only and do not constitute medical advice or a physician-patient relationship and are not intended to be a substitute for, or considered as professional medical advice, diagnosis, treatment, or prescription. I will not

disregard professional medical advice or delay seeking it because of information provided by my coach, and I will consult a licensed health care professional before beginning any new exercise, health, diet or herbal regimen. Furthermore, I agree not to discontinue or alter dosage of any prescription medications, even if I feel better through the coaching process, without first consulting a licensed physician.

 

8. Ayurveda Counselor Scope Of Practice (As defined by AAPNA)

This scope of practice states the Ayurvedic Counselor may offer Ayurvedic wellness services to their clients. This scope emphasizes education on the prevention of imbalances and the promotion of wellness on all levels of being, using the life-enhancing modalities and philosophy of Ayurveda. Approaches include appropriate dietary, lifestyle, yoga, meditation, and health-promoting herbal recommendations. This certificate allows for designing preventive health routines for clients. Assessment tools are used and enabled to determine Prakriti, an individual's body and mind, and the balanced and unbalanced states of the doshas, ama, agni, dhatus, and malas. Those who have obtained this certificate do not diagnose or treat diseases.

 

9. Limitation of Liability Release

IN NO EVENT SHALL KYLE JASON LEITZKE OR ANY OF ITS REPRESENTATIVES BE LIABLE FOR CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES, LOST PROFITS OR REVENUES OR DIMINUTION IN VALUE, ARISING OUT OF, OR RELATING TO, AND/OR IN CONNECTION WITH THIS AGREEMENT. AGGREGATE LIABILITY ARISING OUT OF, OR RELATED TO THIS AGREEMENT, WHETHER BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED THE TOTAL OF THE AMOUNTS PAID TO KYLE JASON LEITZKE.

 

10. Attendance

At the scheduled appointment time, the Client agrees to call, Zoom, or meet with the Coach at an agreed upon number / video meeting / location. The Coach and client commit to start and finish each session on time.

 

11. Rescheduling sessions is possible with 24 hours advance notice. Rescheduled meetings can be used in the same month, carried over to the following month, or banked for scheduling as-needed. 

 

12. Cancellations of individual sessions within 24 hours of scheduled session are forfeited and non-refundable (This needs to be a priority, and I understand life emergencies come up). If the client is more than 10 minutes late for a coaching session, the Coach will assume the session is cancelled and the client will forfeit the session fee.

 

13. Termination of Services 

Either Party may terminate this Agreement immediately upon notice. Notwithstanding the foregoing, Client shall not be relieved of any obligations to pay fees due to Kyle Jason Leitzke solely because of the termination of this Agreement. 

 

14. E-Newsletter

By agreeing to one of Kyle Jason Leitzke’s coaching programs, packages, services, or plans you agree to be added to our e-newsletter list. If you wish to be unsubscribed, please contact support@kylejasonleitzke.com, or unsubscribe on the e-newsletter itself.

 

15. Entire Agreement 

 

This Contract constitutes the entire agreement between the Client and the Coach and the Coach shall not be held responsible and shall remain blameless for any adverse or other consequences, including but not limited to financial, personal, employment or other losses, arising out of decisions or actions the Client may make as a result of the Services provided by the Coach. This agreement supersedes all prior written and oral representations.

 

16. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the State of

California without giving effect to any choice or conflict of law provision or rule (whether of the

State of California or any other jurisdiction).
